VigouR VR operates within South Africa and provides immersive XR sports and virtual reality wellness experiences for corporate, educational, and private clients.

2. Description of Services

Vigour VR provides:

  • Virtual Reality (VR) and XR Sports gaming experiences

  • Corporate wellness activations

  • Team-building events

  • Pop-up VR installations

  • Event-based immersive gaming experiences

  • Wellness-focused interactive entertainment solutions

 

Services may be delivered at client premises, event venues, or designated partner locations.

 

We reserve the right to modify, update, or discontinue any service offering at any time without prior notice.

3. Risk Allocation, Liability & Disclaimers

Assumption of risk

Participation in VR and XR sports activities involves physical movement and sensory immersion.

 

By using our services, you acknowledge that:

  • VR use may cause dizziness, nausea, disorientation, motion sickness, eye strain, or physical fatigue.

  • Physical injury may occur if instructions are not followed.

  • Participation is voluntary and at your own risk.

Limitation of Liability

To the maximum extent permitted by South African law:

  • Vigour VR shall not be liable for any indirect, incidental, special, or consequential damages.

  • Vigour VR is not responsible for injuries resulting from failure to follow safety instructions.

  • Clients are responsible for ensuring participants are medically fit for participation.

 

Vigour VR’s total liability shall not exceed the total amount paid for the service booked.

4. Warranty / Guarantee

Vigour VR guarantees:

  • Professional setup and facilitation of services.

  • Equipment that is maintained and sanitized according to hygiene standards.

  • Delivery of services as agreed in writing.

 

We do not guarantee specific physical, wellness, or performance outcomes.

5. Withdrawal / Cancellation Rights

In accordance with the Consumer Protection Act (South Africa), clients may:

  • Cancel bookings 7 days or more before the scheduled event for a full refund (excluding non-refundable deposits, if applicable).

  • Cancel within 3–6 days prior to the event for a partial refund (percentage to be specified).

  • Cancellations within 48 hours of the event may be non-refundable.

 

Custom corporate activations may be subject to separate written agreements.

6. Safety Information & Proper Use

For safe participation:

  • Users must follow all instructions provided by Vigour VR staff.

  • Users must immediately stop if experiencing discomfort, dizziness, or nausea.

  • VR headsets must be worn properly and used only under supervision.

  • The play area must remain clear of obstacles.

  • Pregnant individuals, persons with epilepsy, heart conditions, or severe motion sickness should consult a medical professional before participation.

 

Vigour VR reserves the right to refuse participation to anyone who appears intoxicated, medically unfit, or behaving unsafely.

7. Terms of Delivery of Service

  • Services are delivered at the location agreed upon in the booking confirmation.

  • Clients must provide adequate space, power supply, and safe operating conditions.

  • Setup and breakdown times will be communicated in advance.

  • Delays caused by venue restrictions or client-side issues may impact service duration.

8. Rights of Use & Intellectual Property

All content, branding, logos, media, software, graphics, and materials on this website and used during events are the property of Vigour VR unless otherwise stated.

Clients may not:

  • Copy, reproduce, or distribute our materials without written consent.

  • Use Vigour VR branding without authorization.

Event photos or videos captured by Vigour VR may be used for marketing purposes unless the client expressly objects in writing prior to the event.

9. Conditions of Use / Purchase

  • Participants must be at least 13 years old unless accompanied by a parent/guardian.

  • Corporate bookings must be made by authorized representatives.

  • Services are currently available within South Africa unless otherwise agreed.

  • Users must comply with all instructions provided by staff.

 

We reserve the right to suspend or terminate services if users violate these Terms.

10. Refund Policy / Exchanges / Termination

Refunds are processed in accordance with the cancellation policy stated above.

Vigour VR reserves the right to:

  • Terminate service if safety rules are violated.

  • Cancel bookings due to unforeseen circumstances (force majeure, equipment failure, venue cancellation).

 

In the event of cancellation by Vigour VR, clients will receive either:

  • A full refund, or

  • The option to reschedule.

11. Methods of Payment

We accept the following payment methods:

  • EFT (Electronic Funds Transfer)

  • Direct Bank Deposit

 

A 50% deposit is required to secure a booking and must be paid within 14 days of the event.

Full payment is required two (2) days before the event. 
All prices are quoted in South African Rand (ZAR).

Late deposit payments may result in cancellation of booking.

12. Website Use

By using this website, you agree:

  • Not to use the site for unlawful purposes.

  • Not to attempt to hack, disrupt, or interfere with site functionality.

  • That Vigour VR may update services, pricing, or content at any time.

 

We reserve the right to suspend or restrict website access if misuse occurs.

13. Changes to Terms

Vigour VR reserves the right to update these Terms at any time. Continued use of our website or services constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

15. Protection of Personal Information (POPIA Compliance)

Vigour VR complies with the Protection of Personal Information Act 4 of 2013 (POPIA) of the Republic of South Africa.
